    1. Acceptance of Terms

    By accessing MDP Auction ('MDP', 'we', 'us', 'our') and using our services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

    2. Bidding Rules

    2.1 Registration

    All bidders must create an account before participating in auctions. You must provide accurate, current, and complete information.

    2.2 Binding Bids

    Every bid placed is legally binding. By placing a bid, you commit to purchasing the lot if you are the winning bidder.

    2.3 Bidding Increments

    Bids must follow the predefined increment structure. MDP Auction reserves the right to reject any bid that does not meet the minimum required increment.

    2.4 Automatic Extension

    If a bid is placed within the last 5 minutes of an auction, the closing time is automatically extended by 5 minutes from the time of that bid. This ensures every bidder has a fair opportunity to respond.

    3. Buyer's Responsibilities

    As a buyer, you are responsible for:

    • Reviewing lot descriptions, images, and condition reports before bidding
    • Understanding that all sales are final upon the close of the auction
    • Paying for won lots within 7 days of the auction's close
    • Arranging for the collection or shipment of acquired items
    • Inspecting items upon receipt and reporting any discrepancies within 48 hours

    4. Payment Terms

    4.1 Payment Deadline

    Full payment is due within 7 days of the auction's close. It must include the winning bid amount, applicable buyer's premium, and any relevant taxes.

    4.2 Accepted Payment Methods

    4.3 Late Payment Policy

    Any delay in payment may result in:

    • Suspension of bidding privileges
    • Late payment penalties on the outstanding balance
    • Cancellation of the sale and forfeiture of any deposit paid
    • Legal action to recover the amounts due

    5. Auction Closing Rules

    Auctions close at the specified time, subject to the extension rules. The highest bidder at the time of closing is declared the winner, provided that the reserve price (if any) has been met.

    6. Dispute Resolution

    In the event of a dispute, MDP Auction's decision is final. We reserve the right to:

    • Cancel bids or sales in cases of suspected fraud or error
    • Re-list a lot for sale in the absence of payment
    • Exclude any user who violates these terms
    • Take appropriate legal action in case of a breach of contract

    7. Limitation of Liability

    MDP Auction acts as an intermediary between buyers and sellers. Although we make every effort to describe items accurately, we cannot be held responsible for errors in descriptions, photographs, or condition reports. Items are sold 'as is' unless otherwise stated.

    8. Governing Law

    These Terms and Conditions are governed by Swiss law. Any dispute falls under the exclusive jurisdiction of the courts of the canton of Vaud, with legal venue in Villars-sur-Ollon.

    9. Modification of Terms

    MDP Auction reserves the right to modify these terms at any time. Continued use of our platform after modification constitutes acceptance of the new terms.
